AI Supplementary Terms

These AI Supplementary Terms (these “AI Terms”) govern your use of any functionality or component of the Services that is identified as AI Functions by DroneDeploy, Inc.’s (“DroneDeploy” or “us”) product documentation, including DroneDeploy’s “Safety AI” product (“AI Products”). By indicating your acceptance to these AI Terms, or enabling or using any AI Product, you agree to be bound by these AI Terms on behalf of the owner of the account you are registering or using (such owner, “Customer” or “you”) and represent that you are authorized to bind them to these AI Terms. If you do not have such authority or do not agree to these AI Terms, do not use the AI Products.

1. Proprietary Rights and Licenses

  • a. AI Functions: From time to time, DroneDeploy may introduce features and capabilities as part of the Services that utilize artificial intelligence, machine learning, or similar technologies (the “AI Functions”). These AI Functions may be developed by DroneDeploy and/or DroneDeploy's third-party providers, and are a part of the Services. DroneDeploy and its licensors exclusively own all right, title, and interest in and to the AI Functions, including all associated intellectual property rights.
  • b. AI Content: You may provide Customer Content for use with the AI Functions (“Input”) and receive output generated and returned by the AI Functions based on the Input (“Output”, and together with Input, “AI Content”). When you use the AI Functions, as between the parties and to the extent permitted by applicable law, you own the AI Content. Other users providing similar Input to AI Functions may receive the same or similar Output. Responses received by other users are not your AI Content. You are solely responsible for your AI Content, including compliance with applicable laws and the Agreement.

2. License

  • a. You authorize DroneDeploy and its third-party providers to process your AI Content to provide you with the AI Functions. To the extent your Input contains personal information (as defined by applicable law and regulation), you instruct DroneDeploy and its third-party providers to process such Personal Information for the purpose of providing the AI Functions and Output.
  • b. DroneDeploy may process, store, and otherwise use AI Content to further develop, enhance, and improve the Services and the AI Functions, and you expressly consent to DroneDeploy's use for such purposes, without accounting, attribution or compensation to Customer.
  • c. You agree that DroneDeploy may use subprocessors to provide the AI Functions to you and may provide access to your Input for the operation of the AI Functions (“AI Subprocessors”). A list of AI Subprocessors may be found at https://dronedeploy.com/legal/subprocessors.

3. Disclaimer. AI PRODUCTS ARE PROVIDED TO YOU ON AN “AS IS” BASIS. DRONEDEPLOY DOES NOT MAKE ANY WARRANTY REGARDING THE RESULTS OBTAINABLE FROM USING AI FUNCTIONS OR THE ACCURACY OR SUITABILITY FOR YOUR NEEDS OF ANY INFORMATION (INCLUDING, BUT NOT LIMITED TO, OUTPUT, MATERIALS, DESIGNS, WORKFLOWS/PROCESSES, CODE, REPORTS, OR OTHER DATA) OBTAINED USING THE AI FUNCTIONS. YOU UNDERSTAND AND AGREE THAT ANY SUCH INFORMATION OBTAINED THROUGH USING AI FUNCTIONS IS AT YOUR SOLE RISK.

4. Usage Restrictions. You may not use AI Functions or Output: You may not use AI Functions or Output (a) to develop foundation models or other large-scale models that compete with DroneDeploy or the AI Products, (b) to mislead any person that Output was solely human-generated, (c) in a manner that violates any technical documentation, usage guidelines, or parameters, (d) to make automated decisions that may have a detrimental impact on individual rights without appropriate human supervision, or (e) in a manner that infringes, violates, or misappropriates any of our rights or the rights of any third party.

5. General

  • a. These AI Terms supplement and/or amend your agreement with DroneDeploy, including the Master Service Agreement or other agreement, as applicable, for the Services (in each case, as applicable, the “Agreement”). All capitalized terms used in these AI Terms and not otherwise defined shall have the meanings assigned to them in the Agreement. All other terms and conditions of the Agreement not expressly modified by these AI Terms shall remain in full force and effect; provided that your use of the AI Functions is not covered by any indemnity obligation of DroneDeploy.
  • b. We may modify these AI Terms from time to time. We will post notice of modifications to these AI Terms on this page. If you do not agree to the modified AI Terms, you should discontinue your use of the AI Products.
